Terms of Service

These Terms of Konami Digital Entertainment Co., Ltd. (hereinafter the “Company”) set out matters related to the KONAMI ID (defined in Article 1) including the use thereof. Before applying for the issuance of a KONAMI ID, you must thoroughly review and consent to the provisions of these Terms. By applying for the issuance of a KONAMI ID, you will be deemed to have consented to all the provisions of these Terms.

If you are a Minor, you must obtain the advance consent of your parent or legal guardian (including the person who has parental authority; the same applies hereinafter) as set out in Article 13 before consenting to these Terms. By consenting to these Terms, a minor customer will be deemed to have obtained the consent of the parent or legal guardian.

 Article 1. (Definition)

  • The following terms used herein have the meanings set forth in the respective items:
  • (1)
    “KONAMI ID” means alphanumeric characters, symbols, and other codes issued upon ID Registration in order to identify you. “ID Registration” means an event where the Company accepts and consents to your application to the Company for the issuance of a KONAMI ID and records your Customer Information in the Company’s database.
  • (2)
    “Konami Service” means the services provided by the Company or its affiliated company where such use requires authentication with the KONAMI ID.
  • (3)
    “Customer Information” means information that you provide to the Company when applying for the issuance of your KONAMI ID, as well as information that the Company acquires in the course of your use of the Konami Service. The Customer Information may include your name, address, telephone number, date of birth, sex, country of residence, language, e-mail address, credit card information, and the individual identification number of your portable terminal or other devices with which you can be identified, as well as the history of your use of the Konami Service.
  • (4)
    “Website” means My KONAMI, a website operated by the Company to provide an application screen for the issuance of the KONAMI ID, an authentication screen for the KONAMI ID, information about the Konami Service, and other information related to the KONAMI ID.
  • (5)
    “Password” means the alphanumeric characters established for the authentication of the identity of a user of the KONAMI ID.
  • (6)
    “Data” means Customer Information related to the KONAMI ID, data or information that you keep in the Konami Service (including Game data), and those that the Company keeps to provide the Konami Service.
  • (7)
    “Minor” means a person who has not reached the age of majority under laws of the country in which you reside at the time of application for the Service.

 Article 2. (Scope of Application of Terms)

  • These Terms apply to all customers who make application for the issuance of a KONAMI ID in any region outside Japan. If there are any other terms provided for the Konami Service, and a provision thereof is inconsistent with that of these Terms, the provision of such other terms will prevail over the provision hereof.

 Article 3. (Handling of Personal Information)

  • The collection and use of Customer Information will be governed by the Personal Information Protection Policy of the Company. Before you provide Customer Information to the Company, you must understand and consent to the provisions of the Personal Information Protection Policy. By providing Customer Information to the Company, you will be deemed to have consented to the Personal Information Protection Policy of the Company. If a provision hereof is inconsistent with that of the Personal Information Protection Policy of the Company, the Personal Information Protection Policy will prevail over these Terms.

 Article 4. (Application for Issuance of KONAMI ID)

  • 1.
    Unless you provide the Customer Information requested by the Company, you may not apply for a KONAMI ID. You may correct your Customer Information on the Website. If you are unable to correct Customer Information on the Website, you may consult the point of contact set forth in, and in accordance with, the Personal Information Protection Policy of the Company, so that you will request removal, correction, or change of the Customer Information kept by the Company.
  • 2.
    You warrant the accuracy of your Customer Information. The Company will, under no circumstances, be responsible for any damage incurred by you or a third party because of the inaccuracy of the information.
  • 3.
    The Company may reject your application for the issuance of a KONAMI ID at our discretion. If the Company rejects your application for the issuance of a KONAMI ID, the Company will not be obliged to disclose to you the reason for such rejection. The Company will, under no circumstances, be responsible for any damage, loss, or disadvantage arising because of the rejection of your application for the issuance of a KONAMI ID.

 Article 5. (Management of KONAMI ID and Password)

  • 1.
    You will manage your KONAMI ID and Password at your responsibility and expense. If your KONAMI ID or Password is or is likely to be used without authorization, you will immediately give notice to the Company. The Company will consider that you have made all acts made prior to such notice with the use of your registered KONAMI ID or Password.
  • 2.
    You will arrange equipment and devices necessary for use of a KONAMI ID at your own expense and responsibility.

 Article 6. (Prohibited Acts)

  • You must not engage in any of the following acts in using a KONAMI ID:
    • (1)
      Act of lending, selling, buying, giving, or otherwise transferring a KONAMI ID or Password to a third party or having a third party use it;
    • (2)
      Act of pretending to be the Company, its affiliated company, another customer, or any other third party or trying to do so;
    • (3)
      Act in violation of legislation, a ruling, decision, or order of a court or an order of an administrative organ;
    • (4)
      Act of inducing, encouraging, or assisting others to engage in any act set forth in these items; or
    • (5)
      Other acts the Company deems inappropriate.

 Article 7. (Temporary Suspension)

  • The Company may, without advance notice, temporarily suspend the service for your use of the KONAMI ID for maintenance or other compelling operational or administrative reasons. The Company will, under no circumstances, be responsible for any damage incurred by you from the suspension of the service for your use of the KONAMI ID under this article.

 Article 8. (Disclaimer)

  • 1.
    In the event that you incur any damage, loss, or disadvantage because of your use of a KONAMI ID or because you are unable to use a KONAMI ID for whatever reason, the Company will be responsible only for actual and direct damage caused to you. Regardless of whether the Company has foreseen it, the Company will, under no circumstances, be responsible for any damage arising out of special circumstances, lost earnings, or consequential damage; provided, however, that this does not apply to any damage caused by intentional acts or gross negligence of the Company.
  • 2.
    The Company will undertake no responsibility whatsoever for any damage incurred by you for the act of a third party. The Company will not become involved in any manner in any dispute arising between you and a third party, and you will settle the dispute at your own expense and responsibility.

 Article 9. (Effect of Terms)

  • The Company may, at any time with advance notice, revise these Terms by giving notice on the Website. The Company will present the revised Terms to you when you use the KONAMI ID after revision of these Terms, and when you confirm it, you will be deemed to have consented to the revision of these Terms. If you do not consent to the revision of these Terms, you will remove and discontinue the use of your KONAMI ID.

 Article 10. (Removal of KONAMI ID by You)

  • You are entitled to remove your KONAMI ID at any time and discontinue using the KONAMI ID and all Konami Services.

 Article 11. (Removal of KONAMI ID by Company)

  • 1.
    The Company is entitled to, by giving notice in the Website, remove your KONAMI ID or discontinue providing the service for your use thereof at any time with advance notice.
  • 2.
    The Company is entitled to remove your KONAMI ID immediately without any advance notice, notification, or demand, if you fall under any of the following items:
    • (1)
      If the Company finds that you violate these Terms or other terms of the Konami Service;
    • (2)
      If you violate an agreement with the Company on any service other than Konami Service;
    • (3)
      If it is found that in the past, the Company has rescinded the membership registration or use of any service or content provided by the Company for reasons attributable to you; or
    • (4)
      If two (2) years or more have elapsed since the day on which you have last used the KONAMI ID.

 Article 12. (Removal of KONAMI ID and Termination)

  • Upon removal of a KONAMI ID, the Company may delete the Customer Information and Data related to the KONAMI ID. The information once deleted may not be restored.

 Article 13. (Minor and Other Persons with Limited Capacity to Act)

  • If you are under the age of 13, you may not use the Service. If you are a Minor at the age of 13 or above, you must obtain the advance consent of your parent or legal guardian when entering into these Terms. By consenting to these Terms, a minor customer will be deemed to have obtained the consent of the parent or legal guardian.

 Article 14. (Governing Law and Agreed Jurisdiction)

  • These Terms shall be governed by the laws of Japan; provided, however, that the application of conflicts of laws shall be excluded explicitly. Any dispute arising in connection to these Terms shall be brought before the Tokyo District Court as the agreed court with exclusive jurisdiction.

 Article 15. (Language)

  • These Terms have been prepared and shall be construed in accordance with the English language. Any translated version is prepared to facilitate the understanding of customers who speak the language of such translation, and if there is any inconsistency between the English version and the translated version hereof in terms of meaning or construction, then the meaning or construction under the Terms in English shall prevail over those under the translated version.
