Terms of Service

These terms of use (the “Terms of Use”) set forth by Konami Digital Entertainment Co., Ltd., (the “Company”) stipulate the matters concerning the use of KONAMI ID (defined in Article 1). You shall fully confirm and consent to the Terms of Use prior to receiving issuance of a KONAMI ID. By submitting an application for issuance of a KONAMI ID, you shall be deemed to have consented to the Terms of Use in its entirety.

As defined in Article 4, Paragraph 2, when you are a person, with limited capacity, such as a minor, prior to submitting the application for issuance of a KONAMI ID, consent must be received from the legal representative (e,g, a person with parental authority; the same shall apply hereinafter). When you, with limited capacity, such as a minor, apply for issuance of a KONAMI ID, consent from the legal representative shall be deemed to have been obtained.

Also, as stipulated in Paragraph 3 in Article 4, a “Child” (referring to a person who has not reached the age separately specified by the Company) may not apply for issuance of a KONAMI ID independently. The legal representative of the Child is required to apply for issuance of a Children’s Account (defined in Article 1).

Article 1 (Definitions)

  • For the purpose of these Terms of Use, the following terms shall have the meanings set forth in each of the following items.
  • (1)
    “Customer et al.” collectively refers to you and your Child.
  • (2)
    “KONAMI ID” refers to the alphanumeric characters, and other symbols used to identify you issued at the time of ID registration. “ID Registration” refers to registration of your information in the Company’s database when the Company accepts the application placed by you to the Company for issuance of a KONAMI ID.
  • (3)
    “Children’s Account” refers to the KONAMI ID issued when you with legal representation authority over a Child apply, as the legal representative of the Child, for issuance of a KONAMI ID that will be under the control of you.
  • (4)
    “KONAMI ID etc.” collectively refers to the KONAMI ID and Children’s Account.
  • (5)
    “Konami Services” refer to, of the services provided by the Company and its affiliates , the services that require authentication through a KONAMI ID or Children’s Account when using the service.
  • (6)
    “Customer Information” refers to the information provided by you to the Company when applying for issuance of a KONAMI ID etc. and the information collected by the Company through the use of the Konami Services. Customer Information may include the name, address, telephone number, date of birth, gender, country of residence, language used, email address, credit card information, and individual identification number of a mobile phone of the Customer et al. that can be used to identify the Customer et al. and the Konami Service usage history of the Customer et al.
  • (7)
    “Website” refers to “My Konami,” the website operated by the Company that contains the KONAMI ID etc. issuance application screen, KONAMI ID etc. authentication screen, Konami Services introduction, and other information concerning the KONAMI ID etc.
  • (8)
    “Password” refers to designated letters and numbers for authenticating the KONAMI ID etc. being used by the Customer et al. to which the KONAMI ID has been issued.
  • (9)
    “Data” refers to the Customer Information related to the KONAMI ID etc., data stored by the Customer et al. in Konami Services (including game data), and data stored by the Company when providing Konami Services.

Article 2 (Scope of application of the Terms of Use)

  • These Terms of Use shall apply to you who applied for issuance of a KONAMI ID etc. in United States. In the event other terms of use exist for Konami Services and a provision of such terms of use conflicts with a provision of these Terms of Use, the provision of such other terms of use shall take precedence.

Article 3 (Handling of personal information)

  • Any personal information collected and used by the Company in relation to your use of KONAMI ID and its related services, including, the Website, will be handled in accordance with the Company’s privacy policy or the privacy notice (“Privacy Policy”) separately presented to you.
    In the event of a conflict between the Terms of Use and the Privacy Policy, the provisions of the Privacy Policy shall take precedence.

Article 4 (Application for issuance of a KONAMI ID etc.)

  • 1.
    When you don’t provide the Customer Information required by the Company, you may not apply for the issuance of a KONAMI ID etc. You may correct the Customer Information on the Website. When it is not possible for you to correct the Customer Information on the Website, please contact the Company in accordance with the Privacy Policy.
  • 2.
    Notwithstanding the provision of the preceding paragraph, when you are a person with limited capacity such as a minor, prior to applying for issuance of a KONAMI ID, consent from the legal representative must be obtained. When you with limited capacity such as a minor applies for issuance of a KONAMI ID, the consent from the legal representative shall be deemed to have been obtained.
  • 3.
    A Child may not independently apply for issuance of a KONAMI ID. The legal representative of the Child is required to apply for a Children’s Account in accordance with the provision of Paragraph 1 of the following article. However, the provision of this paragraph shall not apply to KONAMI IDs issued prior to the revision of these Terms of Use on 01 18, 2022.
  • 4.
    You guarantee that the Customer Information that you provide to the Company is accurate. The Company shall not be responsible for any damage suffered by the Customer et al. and third parties because such information is inaccurate.
  • 5.
    The Company may reject an application for the issuance of the KONAMI ID etc. at its own discretion. When the Company rejects an application for issuance of the KONAMI ID etc., the Company is not obligated to disclose the reason for such rejection to the Customer et al. The Company shall not be responsible for any damage, loss, or disadvantage occurring as a result the application for issuance of the KONAMI ID etc. being rejected.

Article 5 (Children’s Account)

  • 1.
    When you have the legal representative authority over a Child, you may receive issuance of a Children’s Account as the legal representative. In the Children’s Account, use of some of the Konami Services may be partially restricted.
  • 2.
    When issuance of a Children’s Account is received by you as the legal representative of the Child, you must fully explain to the Child the details of the Terms of Use in an easy-to-understand manner.

Article 6 (Management of the KONAMI ID etc. and Password)

  • 1.
    You shall, at your own expense and responsibility, manage the KONAMI ID etc. and Password. In the event your KONAMI ID, Children’s Account, or Password has been or is likely to have been fraudulently used, you shall immediately notify the Company. Until this notification is made, the Company shall deem all actions taken using the registered KONAMI ID, Children’s Account, or Password to be the actions of you.
  • 2.
    You shall prepare the necessary facilities and equipment for using the KONAMI ID etc. at your own expense and responsibility.

Article 7 (Prohibited matters)

  • The Customer et al. may not engage in any of the following actions when using the KONAMI ID etc.
    • (1)
      Except when applying for issuance of a Children’s Account in accordance with the provision of Article5 Paragraph 1 or when the KONAMI ID that manages the Children’s Account is changed, the act of loaning, purchasing, providing, or transferring the KONAMI ID etc. and Password to a third party or causing a third party to use them
    • (2)
      Act of impersonating or attempting to impersonate the Company, the Company’s affiliate, or third party
    • (3)
      Registering or providing false information
    • (4)
      Act in violation of a law, a court ruling, decision or order, or an order issued by a government agency
    • (5)
      Act of instigating, encouraging, or assisting any of the acts listed in this Paragraph
    • (6)
      Otherwise conducting an act that is deemed inappropriate by the Company

Article 8 (Temporary suspension)

  • The Company may temporarily suspend the use of your KONAMI ID or Children’s Account by you or your Child without prior notice in the event of unavoidable circumstances in relation to maintenance or other operational management. The Company shall not be responsible for any damage suffered by the Customer et al. due to the suspension of the KONAMI ID or Children’s Account by you or your Child in accordance with the provision of this article.

Article 9 (Exemption from responsibility)

  • 1.
    In relation to damage, loss, or disadvantage that occurs to Customer et al. as a result of the use of the KONAMI ID or Children’s Account or the inability to use the KONAMI ID or Children’s Account, the scope of liability assumed by the Company shall be regardless of the reason, limited to the actual and direct damage suffered by the Customer et al. Regardless of whether or not such was foreseen by the Company, the Company shall not be responsible for any damage, lost profits, or indirect damage that occurred because of special circumstances. However, this shall not apply to cases where the damage is caused by the intent or gross negligence of the Company.
  • 2.
    The Company shall not be responsible for any damage suffered by the Customer et al. as a result of an action taken by a third party. The Company shall not be involved in any dispute arising between the Customer et al. and the third party, and the Customer et al. shall resolve such dispute at its own expense and responsibility.

Article 10 (Validity of the Terms of Use)

  • The Company may, at any time, revise the Terms of Use by setting a notice period and announcing it on the Website. The Company shall display the revised Terms of Use when you or your Child use the KONAMI ID for the first time after such revision is made, and the Company shall deem that you have consented to the revision when you or your Child confirm the revised Terms of Use. When you are a person with limited capacity, such as a minor, prior consent from the legal representative must be obtained when consenting to the revised Terms of Use. When you with limited capacity, such as a minor, confirms the revised Terms of Use, you shall be deemed to have obtained consent from the legal representative. Customers who are unable to consent to the revised Terms of Use shall delete and terminate the KONAMI ID etc.

Article 11 (Deletion of the KONAMI ID etc. by you)

  • You may, at any time, delete the KONAMI ID etc. or Children’s Account and terminate the use of all Konami Services and KONAMI ID etc. or the Children’s Account and all Konami Services related to such account.

Article 12 (Deletion of the KONAMI ID etc. by the Company)

  • 1.
    The Company may, at any time, delete or suspend use of the KONAMI ID etc. or Children’s Account of the Customer et al. by setting a notice period and announcing it on the Website.
  • 2.
    The Company may immediately delete the KONAMI ID etc. or Children’s Account of the Customer et al. without prior notice or warning in the event the Customer et al. corresponds to any of the following:
    • (1)
      When the Company determines that these Terms of Use or other provisions concerning Konami Services have been violated
    • (2)
      When the agreement with the Company related to a service other than Konami Services has been violated
    • (3)
      When it is found that membership registration or the use of services, contents, etc. provided by the Company was terminated in the past for a reason attributable to the Customer et al.
    • (4)
      When at least five years have passed since the day on which the KONAMI ID or Children’s Account was last used

Article 13 (Deletion of the Data)

  • In the event the KONAMI ID etc. or Children’s Account is deleted, the Company may delete the Data related to the KONAMI ID etc. or Children’s Account. Such deleted information may not be restored.

Article 14 (Governing law and agreed jurisdiction)

  • These Terms of Use shall be governed by the laws of Japan. Application of rules concerning the conflict of laws shall be expressly excluded. In the event of any dispute concerning the Terms of Use, the Tokyo District Court shall be the exclusive court of competent jurisdiction for the first instance.
